Footy Specialist Coaching Academy Terms and Conditions
Defined Terms
In these terms and conditions:
FSCA means Footy Specialist Coaching Academy ABN 74 398 497 332
FSCA program means the specialist coaching programs conducted by FSCA
Claim means, in relation to FSCA, any right, cause of action, charge, claim, action, proceeding, damage, loss, cost, expense or liability incurred by or to or made or recovered by or against FSCA or any of FSCA’s principals, officials, employees, contractors, agents, and/or medical advisers, regardless of how arising and whether present, unascertained, immediate, future or contingent
participant means the person participating in the FSCA program
Copyright
Unless otherwise stated, the copyright in all materials, photographs, films or recordings used or published by FSCA (“materials”), including those displayed on the FSCA website, are owned by or licensed to FSCA. No part of those materials, may be reproduced, in whole or in part, without FCSA’s specific written consent. FSCA reserves all rights in respect of its materials.
Consent
The participant, and parent/guardian of the participant, acknowledge that participation in the FSCA program may involve FCSA conducting certain biomechanical analyses. As part of FSCA’s biomechanical analyses, participants may be filmed, photographed, or recorded in other media as determined by
FSCA. By participating in, or permitting the participant to participate in, the FSCA program, both the participant and the parent/guardian of the participant accept and consent to FSCA filming, photographing or recording the participant in the course of the FSCA program for those purposes, and for
other purposes relating to the conduct of the FCSA program.
The participant and parent/guardian of the participant acknowledge that any film, photograph, or recording taken of a participant in the course of the FSCA program will be the sole property of the FSCA, and may be used by the FSCA in its absolute discretion, in the FSCA program, future FSCA programs, and the promotion, marketing or advertising of the FSCA program, and for other purposes relating to the conduct of the FCSA program as determined by FSCA.
The participant and parent/guardian of the participant acknowledge that neither the participant nor the parent/guardian of the participant are entitled to receive any financial benefit from the FSCA’s subsequent use of any film, photograph , or recording taken of a participant in the course of the FSCA program or for the purposes specified above.

Privacy
All information collected by FSCA in the course of the conduct of the FCSA program shall be subject to FCSA’s Privacy Policy , and in compliance with applicable privacy laws in Australia.
Participation in FCSA program
The participant and parent/guardian of the participant acknowledge that participation in football and its associated training activities, including resistance and/or weight training, and the FCSA program, are physically strenuous activities. The participant and parent/guardian of the participant acknowledge that participation in these activities is physically demanding and that they are aware of the nature of the activities and associated medical and physical risks involved with such activities.
The participant and parent/guardian of the participant confirm to that the participant is physically fit and capable of participating in the FSCA program, and agree that FSCA, its principals, officials, employees, agents, affiliations, and/or medical advisers are not responsible for any loss, injury, illness or death that a participant may suffer as a result of their participation in the FSCA program.
Liability/Release and Indemnity
Except as provided by law, the FSCA will have no liability to any person (including the participant and the parent/guardian of the participant) arising from injury, illness or death as a result of the participant’s participation in the FSCA program.
The FSCA will not be liable for any loss, damage or expense of any kind incurred by the participant or any other person arising out of or in connection with the participant’s, participation in the FSCA program.
The participant and the participant’s parent/guardian (on his or her own behalf and on behalf of the participant) agree to:
- release and forever discharge the FSCA, its principals, officials, employees, agents, affiliates, and/or
medical advisers from any and all Claims that a participant or a participant’s parent/guardian may have or may have had but for this release, arising from or in connection with the participant’s participation in the FSCA program; and
- indemnify, and keep indemnified, to the extent permitted by law, the FSCA, its principals, officials,
employees, agents, affiliates, and/or medical advisers from any Claims, injury, death, loss, damage or expense incurred as a result of or in connection with the participant’s participation in the FSCA program.
The participant and the participant’s parent/guardian acknowledge that it is the responsibility of participant and/or the participant’s parent/guardian to arrange appropriate health and medical insurances.
Parental Supervision
The participant and the participant’s parent/guardian acknowledge that if in FCSA’s opinion, the participant displays antisocial or disruptive behaviour whether before, after or during the FSCA program, the FSCA has the right to require the participant’s parent’s/guardian’s supervision of the participant during FSCA program. If considered appropriate, FSCA may in its sole discretion, terminate or suspend a participant’s participation, and all future participation, in the FSCA program, without notice if in
FCSA’s opinion, the participant or anyone associated with the participant (including their parent/guardian) displays antisocial or disruptive behaviour whether before, after or during the FSCA program.
Payment
A participants place in the FSCA program will only be secured upon payment of the FSCA course fee. The FSCA course fee is $295.00. Upon receipt and processing of of the FSCA course fee, the FSA will send an invoice to the participant or the participant’s parent/ guardian , along with a reference number for that transaction. Please present this reference number at the initial FSCA program session as a proof of payment and identification of the participant.
Cancellations/Refunds
No cancellations will be accepted or refunds given where a participant cancels their place in the FSCA program less than 14 days before the commencement date of the FSCA program.
Should a participant be unable to attend a given FSCA program session, the FSCA will, subject to availability, endeavour to re-schedule the participant to another FSCA program session.
No refunds will be given in the event that a participant is unable to attend an FSCA program session, a rescheduled FSCA program session, or an FSCA program session that has be moved to an alternative location.
No refunds will be given in the event that a participant is asked to leave, or not participate in, any FSCA program sessions, or any part of an FSCA program session.
Disclaimer
The FSCA does not represent that a participant’s participation in the FSCA program will result in improved performance, or pre-selection opportunities with any affiliate football clubs or programs.
FCSA will endeavour to conduct FSCA program sessions even in rain and poor weather, but reserves the right to reschedule or cancel FCSA Program sessions in the event of storms or dangerous conditions. FSCA program sessions that are cancelled will be rescheduled to the next available night on at least one week’s notice by the FSCA.
Changes to FSCA program
FSCA reserves the right to change, alter or vary the content or structure of the FSCA program, or the personnel conducting the FCSA Program at any time without notice, in its absolute discretion.
The FSCA further reserves the right to vary the location of any FSCA program session to an alternative location within 5 km of the scheduled FSCA program location.
